Terms Of Services

Rules and notices for getting a commission

This document was created on March 22nd, 2019, and last updated on August 13th, 2022. All changes will be documented here in case any future conflicts occur due to changes in policy.

 

By commissioning me in any kind of way, you hereby agree to be 18+ years of age and the Terms of Service below, regardless if you have read it or not! Breakage in the agreement may result in any order to be voided and a possible blacklisting.

 

- Summary -

Please state your desired render and view (cel-shaded full-body, sketch headshot, etc.). Even if the commission will be an artistic freedom commission. This is for determining the proper price. Paypal IS NOT used to settle payments! All payments are made through Stripe's invoice system! If you've purchased anything from Gumroad, it is exactly the same way. I will not send an invoice unless I'm ready to work on your art and won't be worked on until paid in full. Payment plans can be discussed if needed. I Will draw adult content but nothing extreme such as gore. Don't rush or be rude in any way. I'm doing my best to get your work completed in a timely manner and to the best of my ability. All WIPs and final submissions are sent through whatever communication platform we agreed on.

I.    General – Main information about commissioning me

A. Behavior – Please treat with respect and kindness

Behavior I deem as rude, hostile, or unreasonable; grounds for a warning or instant termination. Your commission slot will be voided and you will be blacklisted on your second offense. If in the midst of a commission, a refund will be processed. Unacceptable behavior includes but is certainly not limited to:

  • Rude opinions (e.g. "Body is terrible", "Colors really suck", or "This isn't looking good, fix it now". Word your dislikes about what I did and how you want it fixed, politely! Don't be deconstructive because that’s rude and unhelpful)

  • Directive rude language (Including swearing)

  • Hate speech (Any sexist, racist, and/or offensive terms will be warned or warrant an instant termination in services depending on the amount said and severity)

  • Sarcasm (I only want to get as much right as possible! Sarcasm is not helpful)

  • Constant checking (Checking every few days is fine with me. Just don’t ask about your commission multiple times in one day)

  • Begging for a reduced/ omitted price (There will NOT be any specialized discounts for anyone.)

  • Rushing (Constantly checking and demanding. We all need breathing room. See Article III, Sec F)

  • Spamming (Just don’t… I’ll reply as soon as possible but just don’t)

  • Demanding (Please ask politely and we can discuss if it’s possible. Very likely that the change you want will be made but depending on the stage. See Article III, Sec E)

  • Guilt-tripping

  • Passive aggressive communication

  • Cancelation of commission without prior notice

  • Threatening to find a cheaper/ better artist

  • Threatening to report/ create a beware alert with no valid reasons

  • Threatening to harm me or another being either through “hacking”, doxxing, mental, or physical means

 

B. Descriptions – More is better

Please send a description of what you want when necessary. The more detailed it is, the better! However, please refrain from sending unnecessarily long paragraphs. I do not need to know about your character's backstory or secrets relating to a story. Concise lists are preferred. Visual references are recommended if any. However, if you have a complex design, visual references are required. Even a rough MS Paint drawing from you showing your character will be of major help. Any ill behavior about not getting something correct will not be tolerated (See Article I, Sec A). 

Good references to send include:

  • Characters (Rough drawings, detailed drawings, or reference sheets)

  • Poses

  • Color palettes

  • Backgrounds (To recreate if wanted)

  • Any other reference images

 

C. Content – What I will and will not draw

The following are things that I am okay with and not okay with creating. If you’re still not sure about something, please contact me before commissioning.

What I will do:

  • Furries / Scalies / Avians

  • SFW / NSFW anthros

  • SFW quadrupeds

  • Pokesonas

  • Mechanical limbs

  • Paw focused art

  • Solos / Pinups

  • Couples

  • Groups

  • Small amounts of blood

  • Backgrounds

  • Miscellaneous objects

 

What I will NOT do:​

  • OCs you don't have permission to use

  • Bug based OCs

  • Humans

  • Humanoids

  • Kemono styles

  • Grotesque aliens (Predator, Elites from Halo, etc.)

  • Muscular focused bodies (Especially excessive muscles)

  • Balloon / Pool toys / Plushies

  • Excessive blood

  • Inflation

  • Full Body Mechs (such as Transformers)

  • Suggestive / NSFW Quadrupeds

  • Extreme content (Cub, Diaper, Muscle-Gain, Weight gain, Scat, Water-Sports, Vore, Gore, Death, etc. Ask if unsure)

  • Hate art

  • Political art

 

In terms of specialty, I'm very strong with making mice and rat characters while being average with felines. I also have way more experience with drawing furred and feathered characters than scalies and non-furred characters. What I have experience in drawing:

  • Mustelids

  • Avians

  • Rodents

  • Dragons

  • Canines

  • Lagomorphs

  • Ursidaes

  • Manokits​

  • Dutch Angel Dragons

  • Sergals

  • Felines


 

D. Artistic Liberty – Perfection is impossible, please don’t expect it

It is understood that you want the dream creation you have envisioned in my style and I want to do my best to help create that image! However, we are only human and sometimes, mistakes or slight changes will happen. I may make a change through visual judgment (e.g. atmospheric coloring), make an error in coloring or features of your character, etc. Kindly point it out without being rude and I will gladly make the change to the best of my ability if it is not too late (See Article III, Sec E).

 


II.    Payment – Based in the United States and handled through Stripe

A. Currency – United States Dollars

All prices listed are in United States Dollars (USD). It is the client's responsibility to figure out the proper price in their currency if necessary. I do not accept the following as a form of payment:

  • Amino Coins

  • Art (unless we agreed on an art trade which is another agreement entirely)

  • Crypto-currency (Bit, Doge, Lite, Z, etc)

  • Deviant Art Points

  • “Exposure”

  • Personal Possessions

 

B. Options – Stripe Payments

All payments will only be made through Stripe via Invoice! I do not use PayPal for business actions nor do I plan to. If you have purchased an item from Gumroad, the process will be the same since both services utilize Stripe.

 

III.    Process – Drawing Process From Order to Completion

A. Ordering – Filling Out a Form

Ordering a commission from me starts with filling out a Google form whenever I announce that I'm open for commissions. For 2D art, contacting me in any way and asking if I'm open would be best since I don't use forms for 2D commissions yet. If you're selected from the form responses, I will directly message you to discuss more about your commission and ultimately give the final price if it is not already solid. Failure to acknowledge the proposed price within 3 days will lead to the termination of your order. Once I am ready to start your commission, an invoice will be sent to the email provided you provided in the form. I do not ask for payments as soon as possible to ensure anyone can cancel the commission without any financial worries.

Submitting a form does NOT mean that your commission will be automatically accepted (See Article IV, Sec. A). Filling out a form only lets me know who is interested. My commissions are not a first-come-first-serve ordeal.

B. Starting – Creations will begin once payments are being made

I will begin your commission as soon as possible once an agreed amount of payment is received through the invoice. For anything $150 and above, payment plans can be discussed. Just do note that I will NOT give you the final product without the final price being paid in full.

 

C. Progress Check-Ins – Ask if I don’t check in already

I will ask for your approval after each stage before continuing on. You are free to ask for progress yourself if you are curious about your commission. I just ask that you request progress shots in moderation. Every work-in-progress (WIP) image will be excessively watermarked and downgraded in resolution to avoid theft.

 

D. Communication – Direct Messages

All communication and WIP images will be sent only through whatever social media platform you have chosen in the form. I do not wish to communicate strictly through email alone due to how much this method of communication slows down the process.

E. Changes – Ask for changes while you still can 

Please don’t hesitate to ask for changes. Minor changes are encouraged and will likely be done free of charge. However, I will not allow major changes (such as a new pose, different character(s), etc.) after the related stage has passed without extra payments. Especially if you were given the opportunity to voice your concern about the issue beforehand. If you don't respond within 3 days when I ask for your thoughts, I will message you again. If you still fail to respond within 24 hours, I will put your commission on hold for a maximum of 2 weeks and push you down the queue. If you still have not returned any form of communication to me after 18 days without any notice, I will submit whatever files were created/ modified, process a percentage of your refund (which will depend on how far along your commission was), and blacklist you from commissioning me in the future.

 

F. Time – Patience is a virtue

First and foremost, I am a college student with a heavy college schedule Mondays through Fridays. I will do my best to work on weekdays but I can not promise that. Additionally, I do have other things to do other than creating art. I cannot work on commissions every single free second of my life nor do I want to. Granted, I will work on commissions whenever possible but only when I comfortably can. This does not mean that I will let your commission sit for an excessive amount of time. Should the circumstances arise and that I will not be able to work on commissions, I will alert you about the hiatus. With that being said, expect a turnaround time of approximately 1-8 weeks at best upon acceptance of payment. Maybe lower on really good days but certainly within the time mentioned. It all depends on the number of commissions in the queue which will increase the turn-around time.

 

G. Final Submission – Will be a PCloud link

Final submission files of commissions will be a link leading to a PCloud storage link. PCloud is similar to Google Drive, DropBox, etc. The link will contain the final assets of your commission and be styled to indicate that it is yours. Your final commission will be free of anti-theft watermarks and will only be marked with my own signature watermark (See Article IV, Sec C & D).

 

IV.    Rights/Usage – Shared rights

A. Artist – Refusal to commission

I, as the artist, hold the right to decline any commission from any client. I hold no obligation to accept every commission. Whether it's because I don't feel comfortable fulfilling your commission idea or because I'm incapable of doing so. And while I hope to grow as an artist and break my barriers, please understand that I have a limit in my capabilities. 

 

B. Artist – Claims to the art but not the character(s)

As the artist, I am allowed to:

  • Post said art and the progress images in any place and site with proper credit to the character owner (You're free to ask to remain anonymous but keeping art hidden will hinder my gallery)

  • Use the drawing to promote / showcase my artistic abilities

 

C. Client – Claim the character(s) but not the art

As the client, you are allowed to: 

  • Use the copyrighted artwork for non-commercial

    • Please discuss with me for commercial use​

  • Use the artwork for commercial uses only if we discussed it (3D avatars for VTuber / streaming reasons are perfectly fine and we don't have to discuss)

  • Post and / or print the art, and claim the right of their character(s) but not the drawing itself

 

D. Infringement – Don’t claim or alter the work you did not do

As the client, you are NOT allowed to:

  • Take credit for the creation of the artwork.

  • Not properly credit the artist ("Credit to the artist" is not acceptable)

  • Remove any watermarks/ signatures. 

  • Alter the artwork without the artist's consent (rule doesn't apply to 3D avatars as long as it's not hateful or defamatory).

  • Use for NFT purposes

 

V.    Refunds – They’re reduced

A. Cancelation Times – When it is best to cancel

Please, be extremely sure that you, the client, actually want to commission me and have the funds to do so. As the client, you are able to cancel your order anytime before I send the invoice. Just let me know that you no longer wish to continue. If accepted progress was already made on your commission, any cancelation afterward will result in a reduced refund (depending on how much was left). So, it’s best to really make the final decision to commit early on before paying the invoice.
